I.    NOTICE TO PARENTS OF CHILDREN UNDER 13 YEARS OF AGE

Consistent with the Children's Online Privacy Protection Act of 1998 (“COPPA”), We do not, and will never knowingly, request personal information from anyone under the age of 13 without prior verifiable parental consent. As a policy, no person under the age of 13 is permitted without parental authorization to interact with GOAT USA online or make purchases from us without their parent’s consent. In the event that We discover that a child under the age of 13 has provided personal information to us, We will delete the child’s personal information in accordance with COPPA. •    Internet or other electronic network activity information, including information regarding Your interaction with Our Website, or advertisement, referring webpage/source through and mobile device/application from which You access Our Website, transaction and browsing history, cookie ID, device advertising ID, device information (e.g., device model, operating system version, device date and time, unique device identifiers, mobile network information, etc.), non-identifiable request IDs, emails, clicks, search terms, pages visited, usage details such as time, length and frequency of interactions and statistics associated with the interaction between device or browser and Our website. 
•    Approximate geolocation data, including information about what city and state Your device is located in when accessing Our Website.

If You visit Our offices or stores, or attend Our in person events, We may collect and use the following categories of personal information about You:

•    Identifiers such as Your real name, alias, postal address, email address, telephone number, date of birth, title (such as Mr., Ms., Mrs., Dr. or similar), payment method preferences, partial account or payment card numbers, special status designations (e.g., teacher, college student, military), or other similar identifiers.    
•    Personal information described in the California Consumer Records Act, Section 1798.80, subdivision (e). This may include Your real name, postal address, email address, telephone number, date of birth and gender.
•    Protected classification characteristics under California or federal law. This includes Your age, date of birth, zip code, and gender. 
•    Audio or visual information. We may capture video and still footage of the public spaces in Our stores, offices, live events and locations, including entrance halls, stairwells, common areas, storerooms, parking lots, etc. If You visit Us in Our offices, stores and/or in-person events, Your image and likeness may be recorded or captured. The purpose of collecting video footage is to deter and investigate crimes and legal claims, to assist crime-investigative authorities in criminal investigations and to support legal claims. 
•    Other identifying information that You voluntarily chose to submit to Us.  
•    Inferences drawn from the information above, such as Your language preferences.

We obtain the categories of personal information listed above from the following categories of sources:

•    Directly from You or Your representatives. For example, information that Our customers provide to process their orders made on Our Website or in person at stores or live events.

•    Directly and indirectly from activity on Our Website. For example, Website usage details are collected automatically.

•    From Our service providers and third parties pursuant to data sharing agreements. For example, we work with payment processors and shippers that allow us to process Your purchases and ship them to You, or process returns. We also work with third parties such as analytics providers, ad tech providers, and others that help us understand how our customers engage with our products and content and to market our products and services to You. This may be done via third-party technologies, including cookies, pixels, web beacons, software development kits and similar technologies. IV.    Business and Commercial Purposes For Collecting Personal Information From Consumers

GOAT USA processes Your personal information as needed to sell and deliver goods, deliver marketing and advertising messages, promote sporting events, athletes, sporting organizations, associations, and groups, conduct contests, games of skill and games of chance, and to meet Our contractual and other legal obligations. 

We may use Your personal information for the following business purposes: 

•    To process Your orders and transactions.

•    To fulfill and manage purchases, orders, deliveries, payments, and returns/exchanges.

•    To provide information related to goods, special offers, services, sweepstakes, promotions, or other relevant information through Our Website and/or trusted sponsors, partners, or licensees.

•    To deliver coupons, mobile offers, newsletters, in-store receipt messages, emails, mobile messages, targeted advertising and social media notifications.

•    To provide features to simplify user experience upon return to Our Website (for example, keeping items in Your cart even if You navigate away from Our Website).

•    For internal administration, data analysis, billing, and detecting, preventing, and responding to actual or potential fraud, illegal activities, or intellectual property infringement.

•    As necessary or appropriate to protect the rights, property or safety of GOAT USA, Our clients or others, including system and network administration and security, infrastructure monitoring, identity and credential management, verification and authentication, and access control; monitoring and other controls needed to safeguard the security and integrity of transactions and/or recordation of information.

•    To host, store and otherwise process information needed for business continuity and disaster recovery.

•    To respond to law enforcement requests and subpoenas from law enforcement agencies and courts in the United States and other countries where We operate, and as required by applicable law, court order, or governmental regulations.  

•    To comply with laws and to assist law enforcement as may be needed.

•    To evaluate or conduct a merger, reorganization, dissolution, or other sale or transfer of some or all of Our assets, or similar corporate transaction or proceeding, in which personal information held by Us is among the assets transferred.

•    Approximate geolocation data, specifically, is processed in order to assess Our compliance obligations under the data privacy laws, as well as to determine how customers in different jurisdictions interact with Our  Website and product offerings, improve Our products, provide You with information, products or services that You request from Us, to identify the closest GOAT USA or third party retail store where GOAT USA items may be purchased, and to protect GOAT USA, its employees, clients, and the public against theft, legal liability, fraud, or abuse.

We may also process Your personal information for the following commercial purposes:

V.    Disclosure of Personal Information to Our Service Providers

In order to fulfill the business purposes identified in Section IV above, We may partner with service providers such as fulfillment companies, shipping and returns companies, payment processors, and various technology vendors. We may disclose Your personal information to a service provider for a disclosed business purpose.  When We disclose personal information for a business purpose, We enter a contract that describes the purpose and requires the service provider to both keep that personal information confidential and not use it for any purpose except performing the contract. In addition to service providers, we work with third parties for targeted advertising and analytics for commercial purposes, as discussed in Section VI below. 

VI.    Categories Of Personal Information We Have Sold Or Shared In The Preceding 12 Months; Categories of Third Parties To Whom Such Information Was Sold Or Shared

While under most circumstances GOAT USA’s information practices do not involve the sale or sharing of consumer personal information, some consumer privacy laws broadly define these and similar terms. According to California consumer privacy law, a “sale” includes disclosing, making available or communicating personal information to a third party (except Our service providers or contractors) in exchange for monetary or other valuable consideration. “Sharing” includes disclosing, making available or communicating personal information to a third party for cross-context behavioral advertising, whether or not for any monetary or valuable consideration. 

Certain of Our services to You may be deemed a “sale” or “sharing” under applicable law. For example, GOAT USA may share the information it collects with third parties, such as data management companies, analytics companies (e.g. Google Analytics), mobile marketing services, chat providers, promotions vendors, and data enhancement services.  We utilize third party services for the commercial purposes discussed in Section  IV of this Policy.

VII.    Our Use of Consumers’ Sensitive Personal Information 

GOAT USA does not process sensitive personal information on Our customers, potential customers, visitors to Our Platform or consumers that interact with Us in person at events, Our stores or Our offices. To the extent that You submit Your financial information for the purposes of making a purchase from Us, payments are processed by Our service providers and GOAT USA only receives information on the last four digits of the payment account that You used. We receive this information in order to be able to show to You which payment account You used to make a purchase from us. 

VIII.    Cookies and Similar Technologies

GOAT USA, certain service providers operating on GOAT USA’s behalf, and third parties may collect information about Your activity, or activity on devices associated with You, on Our Website using tracking technologies such as cookies, pixels, tags, application program interfaces, and web beacons.  GOAT USA may collect information whether or not You are logged in or registered, and may associate this tracking data with Your GOAT USA account.   

Cookies are small text files placed on Your device to store data that can be recalled by a web server in the domain that placed the cookie. We use cookies and similar technologies for storing and honoring Your preferences and settings when accessing and interacting with Our Website, combating fraud, analyzing how Our Website performs, customizing advertisements, and fulfilling other legitimate purposes. We also may use “web beacons” to help deliver cookies and gather usage and performance data. Our Website may include web beacons, cookies, or similar technologies from third-party service providers.


We may allow certain third parties, such as data analytics or online advertising service providers, to collect Your browsing activity on Our Website and applications in a manner that may be deemed to involve a sale of personal information under applicable law. 

GOAT USA participates in interest-based advertising where We use third parties to display content that is tailored to Your individual interests based on how You shop online, as well as to provide advertising-related services, such as ad delivery, reporting, attribution, analytics, and market research.  These parties typically use a cookie, web beacon or other similar tracking technology to collect this information.

GOAT USA may also link Your devices so that content You see on one device can result in a relevant experience on another device, which allows GOAT USA to deliver more personalized advertising messages to You.  For example, if You place an item in Your cart on Our Website and You navigate away from Our Website, GOAT USA will be able to show You an advertisement featuring that item on another device that We believe belongs to You.

GOAT USA may also display targeted ads to You through select social media platforms.  Such ads are sent to groups of people that share traits such as common commercial buying habits and demographics.  Please make sure to check the individual policies of each social media platform to better understand these types of ads.

We are not responsible for these services, including, without limitation, the security of the data they hold about You. EMAIL COMMUNICATIONS

You may unsubscribe from our marketing email communications by clicking the “unsubscribe” link found in every commercial email we send or by visiting the following link and completing the unsubscribe process: UNSUBSCRIBE. Unsubscribing from our marketing communications will not affect the level or quality of service we provide to you.

TEXT/SMS MESSAGES

GOAT USA offers you an option to opt in to receive text/SMS messages from GOAT USA. You may opt in to receiving text messages and alerts on the mobile phone number(s) you provide to us. Once you opt in, we may send you text messages (i) regarding your account; (ii) about our products and promotions (including advertisements, sales, and special offers); (iii) to investigate or prevent fraud; and (iv) to alert you in the event of an issue with any of your purchases. You do not have to opt in to text messages and alerts to use and enjoy our Platform or products. If you opt in, standard text messaging charges may apply. Message frequency may vary. You may choose to opt out from our text messages and alerts at any time.

IX.    How Long Your Personal Information Will Be Kept

Consistent with Our legal obligations, We will keep Your personal information for the duration of time necessary to provide the services or products You requested to You for the duration of time You maintain an account with Us, unless Our legal or contractual obligations require Us to retain Your personal information for a longer period.
Thereafter, We will keep Your personal information for as long as is necessary to do any of the following:

•    To respond to any questions or complaints made by You or on Your behalf
•    To comply with legal obligations and to enforce Our rights
•    To show that We treated You fairly
•    To keep records required by law

We will not retain Your personal information for longer than necessary to effect the purposes set out in this Policy. Different retention periods apply for different types of personal information. When it is no longer necessary to retain Your personal information, We will delete or anonymize it.

Our computer systems are based in the United States. If You reside in other jurisdictions and if You interact with Us via Our Platform or subscribe to Our services, We will collect and process Your personal information in the United States. Right To Correct The right to request that We update any information about You that is inaccurate or incomplete. Once We receive, verify and confirm Your request, We will update (and direct Our service providers to update) Your personal information in Our records. You also have the right to require Us to restrict processing of Your personal information in certain circumstances, e.g. if You contest the accuracy of the personal information. 
Right to Opt-Out of the Sale or Sharing of Personal Information The right to opt-out of the sale or sharing of their personal information by Us. Once We receive, verify and confirm Your request, We will no longer sell or share Your personal information. 
Right to Limit the Use or Disclosure of Sensitive Personal Information The right to request that We limit Our use of Your sensitive personal information to that which is necessary to perform the services or provide the goods that You purchased, with some narrowly tailored exceptions. As discussed above, GOAT USA does not process sensitive personal information of our customers, potential customers or visitors.
Right to Opt Out of Automated Decision Making The right to opt out of automated decision making, including profiling, against any information GOAT USA has collected about You.
Right to Non-Discrimination We will not discriminate or retaliate against You for exercising any of Your privacy rights. In that regard, We will not take the following actions in response to Your exercising of Your privacy rights, unless permitted by the applicable laws:

This notice should be read in conjunction with the rest of Our privacy policy. This section is intended to inform Canadian residents of their rights. This Privacy Notice applies to personal information that GOAT USA collects or processes about individual Canadian residents. 

In response to all privacy requests, GOAT USA will take steps to verify Your identity and/or the legal authority prior to processing any request.  Please follow the instructions to verify the request.  GOAT USA will use the information provided to match the identifying information we have to verify Your identity before processing the request.

Should You wish to know or verify the personal information GOAT USA holds about You, rectify it or have it permanently and entirely deleted from our records, please contact Us using the contact information provided in the “Managing Your Privacy Rights and Choices” section below.

Please note that, in an effort to prevent fraudulent or unauthorized access requests, We may require You to identify Yourself and to verify Your identity.

Upon receipt of such a request, GOAT USA undertakes to respond to Your request within 30 days. Under some circumstances, We may need an extension of time to respond to Your request, in which case We will inform You of the basis for Our need for an extension.  If GOAT USA is unable to provide access to all the personal information it holds about You, the reasons why shall be communicated to You. You may also request the deletion of Your personal information, subject to legal and contractual restrictions; however, please note that the deletion of certain information may affect Our ability to provide You with certain services. Should You request the deletion of Your personal information, GOAT USA reserves the right to retain some of it for a reasonable period of time in order to meet its legal obligations.

Right to Opt Out

You may generally withdraw Your consent to the use or disclosure of Your personal information at any time, subject to the restrictions provided by law or contract. If You wish to withdraw Your consent, please contact Us using the contact information provided in the “Managing Your Privacy Rights and Choices” section below.  However, without such consent, We may be unable to provide You with certain services or benefits. If You are a California resident, You may be limited in the number of verifiable consumer requests for access or data portability to two per 12-month period. The verifiable consumer request must:

•    Provide sufficient information that allows Us to reasonably verify You are the person about whom We collected personal information or a legally authorized representative. 
•    Describe Your request with sufficient detail that allows Us to properly understand, evaluate, and respond to it.
•    Before responding to Your privacy rights request, We must verify Your identity. We will do so by matching at least two reliable data points from Your request to the information that We maintain about You. In certain circumstances, We may require further verification, including obtaining Your signed declaration under penalty of perjury to further confirm that You are the requester. Once You contact Us to exercise Your rights, We will further guide You as to Our verification process.

We cannot respond to Your request or provide You with personal information if We cannot verify Your identity or authority to make the request and confirm the personal information relates to You.  Making a verifiable consumer request does not require You to create an account with Us.  We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

b.    Authorized Agents

Only You or a person that You or Your employer authorize to act on Your behalf may make a verifiable consumer request related to Your personal information. You may also make a verifiable consumer request on behalf of Your minor child. You may use an authorized agent to submit a privacy rights request on Your behalf if You provide the authorized agent a written permission signed by You. We may also require You to do either of the following:

(1) Verify Your own identity directly with Us.
(2) Directly confirm with Us that You provided the authorized agent permission to submit the request.

We may deny a request from an authorized agent if the agent cannot or does not provide to Us Your signed permission demonstrating that they have been authorized by You to act on Your behalf or if You do not confirm to Us that You provided the authorized agent permission to submit the request. 

The requirement to obtain and provide written permission from You does not apply to requests made by an opt-out preference signal.

c.    Response Timing and Format

We will acknowledge Your request no later than ten (10) business days after receiving Your request and will provide information about how We will process the request. The information provided shall describe in general Our verification process and when You should expect a response, except in instances where We have already granted or denied the request.

We shall respond to a verifiable consumer request within forty-five (45) calendar days of its receipt (unless a different response period is required by an applicable law, of which we shall advise you with our response). If We require more time (up to 90 days), We will inform You of the reason and extension period in writing.  If You have an account with us, We will deliver Our written response to that account.  If You do not have an account with Us, We will deliver Our written response by mail or electronically, at Your option.  Any disclosures We provide will only cover the 12-month period for California residents preceding the verifiable consumer request's receipt.  The response We provide will also explain the reasons We cannot comply with a request, if applicable.  For data portability requests, We will select a format to provide Your personal information that is readily useable and should allow You to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to Your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If We determine that the request warrants a fee, We will tell You why We made that decision and provide You with a cost estimate before completing Your request. For example, in cases where requests from a consumer are distinctly unsubstantiated or excessive, in particular because of their repetitive character, We may either charge a reasonable fee, in Our discretion, taking into account the administrative costs of providing the information or communication or taking the action requested; or refuse to act on the request altogether.

XIV.    GLOBAL OPT OUT PREFERENCE SIGNAL 

Global Opt-Out Preference Signal or Global Privacy Control (GPC) is a feature available in some web browsers that allows users to communicate their preference for not being tracked across websites. Currently, only certain internet browsers (DuckDuckGo, Brave, Mozilla Firefox, etc.) or a separately installed plug-in enable universal opt-out signals. While the Global Privacy Control and universal opt-out signals are still developing, We are monitoring the status of implementation and are consistently configuring Our Website to honor consumer’s opt-out signals.
Processing this signal typically involves several steps, including:

Receipt and verification of the signal: When We first receive the opt-out preference signal from Your device, We will verify that it is authentic and valid. This may involve confirming Your identity, ensuring that the signal was sent from a valid email or other contact address, or using other methods to ensure that the signal is legitimate.

Updating data systems: Once the opt-out preference signal has been verified, We will update Our data systems to reflect Your preferences. This may involve adding Your name and contact information to a "do not contact" list or other database, or marking Your existing record in a customer relationship management (CRM) system as opted-out.

Communicating changes to relevant parties: If Your opt-out preference signal affects other parties who have access to Your personal information, such as third-party service providers or partners, We will communicate the changes to those parties and ensure that they also update their data systems accordingly.

Compliance monitoring: We will monitor Our data systems and processes to ensure ongoing compliance with Your opt-out preference signal. This may involve periodically reviewing Our data systems to ensure that Your preferences are being respected, and taking corrective action if necessary.

If You want to turn on Global Privacy Control on Your browser, You can follow these steps:

1. Open Your web browser and go to the settings or preferences menu. The location of this menu may vary depending on the browser You are using.
2. Look for the "Privacy" or "Security" section in the settings or preferences menu.
3. Scroll down to find the option for "Global Privacy Control" or "Do Not Track."
4. Toggle the switch to turn on Global Privacy Control. In some browsers, You may need to check a box or select a radio button to enable this feature.
5. Once Global Privacy Control is turned on, Your browser will send a signal to websites that You do not want to be tracked. However, it's important to note that not all websites may honor this signal, and some may continue to track Your activity.
6. To verify that Global Privacy Control is working, You can visit the website https://globalprivacycontrol.org/  and check if it displays a message indicating that Your browser is sending the "Do Not Track" signal.

By turning on Global Privacy Control on Your browser, You can have greater control over Your online privacy and limit the amount of information that websites and advertisers can collect about You.

XV.    KEEPING YOUR PERSONAL INFORMATION SECURE

GOAT USA has reasonable technical, physical and administrative security measures in place to prevent personal information from being accidentally lost or used or accessed in an unauthorized way. These measures offer appropriate reasonable security, taking into account the state of the technology, the implementation costs and also the nature, the scale, the context and the processing purposes. We limit access to Your personal information to those who have a genuine business need to access it. Those processing Your information will do so only in an authorized manner and are subject to a duty of confidentiality. The measures are also intended to prevent unnecessary collection and further processing of personal information. The personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. We also have procedures in place to deal with any suspected data security breach. We will notify You and any applicable regulator of a suspected data security breach where We are legally required to do so.

XVI.    DISCLAIMER/LIMITATION OF LIABILITY FOR DATA INPUT ERRORS

GOAT USA is not responsible for any errors that are made by You in inputting data, nor for data entered by someone using Your credentials.  PLEASE SECURE YOUR CREDENTIALS AND DO NOT DISCLOSE THEM TO ANYONE ELSE.  If Your credentials are compromised, please notify Us at Privacy@goatusa.com.

Under no circumstances shall GOAT USA be liable to You, including but not limited to any liability for  our Website not being available for use, for lost or corrupted data.   Except as expressly agreed to by us, GOAT USA will not be liable for any consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party.

We reserve the right to amend this Policy at our discretion at any time.
